BWA Letter to the Upper Trinity Groundwater Conservation District
August 10, 2026
Upper Trinity Groundwater Conservation District
1859 W Hwy 199 PO Box 1749
Springtown, TX 76082
The Brazos Watershed Alliance opposes the application of Pacifico Spunky LLC for the use of four (4) wells on their optioned property to be used for gas power generation by 16 simple cycle gas turbines and an undetermined, projected or build-out, number of data center(s). Their application states the initial usage for a data center, but not the data center(s) water usage in other phases of development. They also state almost no water usage for the gas-powered turbines. Pacifico Spunky LLC states well water usage is 9,125,000 gpy. On their AMUD application, Pacifico Spunky LLC stated future increased water needs are projected to exceed their stated number. On their UTGCD application, no water for construction or power generation is included.
Pacifico Spunky LLC refuses to release names of their third party partners, even though they base water usage estimates on "proprietary" information from these third party partners. Pacifico Spunky LLC has never completed a gas powered plant, a BESS, or data center(s).
As is evidenced by the concept plan submitted to the Hood County Commissioners Court, there will be a wastewater pond on the site. The pond is not lined and contamination of the aquifer is possible.
Acton Municipal Utility District was stated on the Pacifico Spunky LLC concept plan submitted to Hood County Commissioners Court as their centralized source of water. AMUD rejected the Pacifico Spunky LLC application stating that the area was not presently part of their district and that they would focus on residential customers and businesses.
The concern of all members of the Brazos Watershed Alliance is that well water usage will exceed the stated amount, thereby jeopardizing other well users that rely on the aquifer for domestic use and water for ranching. These existing users are in very close proximity to these wells. All users of the Trinity Aquifer are at risk when a large mega user over pumps their wells. Due to Pacifico Spunky LLC's inability to accurately state their water usage, the Brazos Watershed Alliance requests that their application be denied.
Further, the Brazos Watershed Alliance requests in depth analysis of each well be performed to determine their present status. An analysis to determine if this industrial use is sustainable without reducing available water for other users of the Upper Trinity Aquifer is also requested.
Members of the Brazos Watershed Alliance request a contested hearing be called to determine by the State of Texas if this application by Pacifico Spunky LLC can be denied.
